The Department of Education’s Civil Rights Division is taking on tracking and ability grouping in school districts where they lead to unequal racial representation in high-level classes, charging that black students are not being provided an equal opportunity to participate in advanced learning opportunities.
Mike Petrilli argues that these and other actions by the Office of Civil Rights show a disregard for the notion that federal power is limited by our Constitution: illustrate an almost endless faith in federal bureaucrats’ ability to intervene effectively and positively in faraway places; and disadvantage the poor and minority children who deserve our greatest support.
